Terms of use of the online store
1. These terms of use apply between the buyer of the MyEye.ee online store (hereinafter the Consumer) and the service provider MyEye OÜ, registry code 17149953 (hereinafter MyEye) when providing/purchasing goods and services.
2. In addition to these terms of service, the legal relationships arising from the purchase of products from the MyEye online store are regulated by the Law of Obligations Act (hereinafter the Law of Obligations), the Consumer Protection Act (hereinafter the Law of Obligations) and other legislation in force in the Republic of Estonia.
3. MyEye reserves the right to make changes to the terms of sale, which we will notify about via the website.
Price information
1. All prices in the MyEye online store are in euros and include VAT;
2. MyEye has the right to make changes to sales prices, but these changes must be reflected in our online store.
3. If an order is placed before the terms of sale or prices are changed, the terms and conditions in force at the time of placing the order will apply.
Placing an order
1. Add the items you want to the cart and, for a one-time purchase, click “Checkout”.
2. On the checkout page, fill in the required fields, choose a delivery method, and click “Place order”. After that you will be directed to your bank to complete the payment.
3. If you choose a subscription, you agree to enter your credit card details and allow automatic payments at the selected interval.
4. Make sure your card has enough funds on the payment date for the subscription charge.
5. You may pause the subscription after the 6-month period by doing it in your myeye.ee account or by emailing info@myeye.ee.
6. Orders placed in the MyEye online store are processed on business days (Mon–Fri) from 9:00 to 17:00.
Payment
1. Under the sales contract, MyEye undertakes to transfer the Goods to the Consumer and enable the transfer of ownership. The Consumer undertakes to pay the amount indicated on the invoice and accept the Goods.
2. The sales contract enters into force once the Consumer’s payment has been received on MyEye’s bank account.
3. Orders that remain unpaid will be cancelled 48 hours after the order has been placed.
Delivery
1. After the sales contract enters into force, MyEye prepares the order (or, if not in stock, orders it from a partner) and hands it over to the logistics partner for delivery.
2. The Consumer can receive the order via Unisend , Omniva or DPD.
3. Each product includes separate delivery information, and the delivery time starts from the moment the payment is received on MyEye’s bank account.
Right of return
1. After receiving the order, you have the right to return unused products purchased from MyEye.ee within 14 days. According to § 53 (4) of the Law of Obligations Act, the Consumer has no right of return for goods that cannot be returned due to their nature. Opened packages of contact lenses, contact lens care liquids, prescription glasses, as well as plus-power, toric and multifocal lenses cannot be returned.
2. To return the goods, send a freely written email to info@myeye.ee no later than 14 days from the date of receipt.
3. Once the return request has been received, MyEye will refund the amounts paid after the returned products have been received.
Force majeure
MyEye is not liable for any damage caused to the Consumer or for delays in the delivery of goods if the damage or delay is due to circumstances that MyEye could not influence or foresee.
Liability
The Consumer must use the MyEye online store only for purposes that comply with the law and good practice, and the Consumer is solely responsible for the devices, software and data connection systems required to use the MyEye online store.
Submitting complaints
1. MyEye is liable for any non-conformity or defects of the goods sold to the Consumer that appear within two years from the date the goods are handed over to the Consumer.
2. If a defect appears, stop using the goods immediately.
3. Repair or replacement of defective goods will be agreed between MyEye and the Consumer. Repair costs are covered by MyEye.
4. MyEye is not liable for defects caused by the Consumer, including improper storage or use that does not follow the intended purpose.
5. In case of non-conformity or defects, please send a complaint to info@myeye.ee, including the name of the purchaser, contact phone number, order number and a detailed description of the defect or non-conformity.
6. A complaint must be submitted within two months from the moment the defect or non-conformity is discovered.
7. All complaints will be reviewed and the Consumer will be contacted as soon as possible, but no later than 14 days after the complaint has been received.
8. The Consumer has the right to request a price reduction, contract termination or a refund if MyEye is unable to repair or replace the goods, if repair or replacement fails, if the defect is not remedied within a reasonable time, or if unreasonable inconvenience has been caused.
Consumer’s right
f the Consumer does not agree with the solution offered by MyEye and believes that their rights have been violated or their interests harmed, the Consumer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection Authority or take the matter to court. The Consumer may file the complaint personally or through a representative. Information about the Consumer Disputes Committee is available on the website of the Consumer Protection Authority. For issues arising within EU member states, the Consumer may contact the European Consumer Centre.
